Congress Approves Native American Housing Bill

President Bush on 10/3/08 received a bill (H.R. 2786) passed by Congress to reauthorize and amend the Native American Housing Assistance and Self-Determination Act (NAHASDA) and the Native American housing and economic development programs that fall under it. One provision creates a new program under which tribes may use up to 15% of their annual NAHASDA grant for housing activities not approved or directly regulated by the U.S. Department of Housing and Urban Development (HUD). A second provision clarifies that tribes can compete for HUD HOME program funds. A third excludes from NAHASDA income a developer’s fee paid to a tribe for a low-income housing tax credit project initially funded with NAHASDA grant dollars, provided the fee is approved by the state housing credit agency.
